Supreme Court refuses to Stay CEC appointment law!
New Delhi-JAN-12, The Supreme Court of India has refused to stay the implementation of the new law appointing Chief Election Commissioner (CEC) and Election Commissioner (EC). A law that excludes the Chief Justice of India (CJI) from the selection committee is being challenged on suspicion of violating the separation of powers.
The court issued notice to the Central government but refused to grant an immediate injunction, stressing that it was a statutory provision. The new law, which came into force on December 28, 2023, will establish a search committee headed by the Union Law Minister to select CECs and ECs. The court is scheduled to consider the constitutionality of the law in April.
